The Gag on Oil Royalties Issue

It is impossible to gag UMNO members from speaking about this matter. Hishamuddin does not know what is spoken loudly at the Whitehorse Kopitiam in KB, all over the Siti Khatijah market, the new bazaar, - indeed all over the country. They are saying UMNO has been deceiving the Malays all this while. But Hishamuddin would rather have us be defenseless and not speak and assert leadership over this issue. They are saying has UMNO got things to hide?
Rather than impose a gag order on this issue, the better option is to exercise leadership over this issue by telling it as it is and doing what is right. Hishamudin is asking us UMNO members to retreat from asserting leadership. If we can't carry our political leadership in Kelantan, at least, let us carry some moral leadership. Acting virtuous isn't a monopoly of PAS leadership.
We must speak through proper channels. What do proper channels mean? We write a paper and pass it to some SUSK to have passages here and there marked in highlights and red markers and then, the SUSK, the other secretaries apply their minds there and tell their ministers? Or better still- we speak in a hostile forum where the only agenda at the end is to ask the party sack Tengku Razaleigh? When the PM says, he is letting UMNO members decide on TRH, what he is saying is, TRH stays. What he is also saying is, Rais is nuts and Hisham misses the cue. All we could muster at the end of the day is to say Razaleigh spoke at the enemy's stage. That's a No No.
UMNO has treated Razaleigh as persona non grata for years. He was the first PETRONAS chairman and yet, PETRONAS has never invited him to its big celebrations. That was because PETRONAS was controlled by Dr Mahathir. PETRONAS was also the private kitty of Malaysian PMs. You have literally ignored the man and now the UMNO leadership is crying foul? The problem is- he is not easily cowed and dismissible. He has the inside track about PETRONAS and the PDA.
But does the gag order apply to UMNO leaders even if they dished out stupid thoughts about this issue? Rais Yatim has already issued advertisements which raised more doubts than clearing matters. We have already debunked the advertisements issued by our Information Minister. That was his over exuberant thoughts on the matter and they were dismissed as pathetic attempts by an increasingly replaceable minister to stay afloat politically. It was just a stunt by Rais to overkill the issue and probably, no, most certainly intended to ingratiate himself to the PM.
You can't stop people talking about this issue. If you stop, then by default, all the opposition people will have a field day speaking about this matter and earning growing allegiance. Then by default, they would assume political and moral leadership. UMNO isn't improving things either by rolling out the red carpet for PKR degenerates.
The refusal by UMNO leadership to tell it as it is about the PDA and the entitlement of states proximate to the oil sources is tantamount to political deception of the highest order. Imposing a gag on UMNO members to speak about this matter, refusing or declining ownership and responsibility over it, is the same as condoning deceit before, now and forever.
Where does wang ehsan originate from? If it's from the revenue collected from PETRONAS, it is covered under the PDA. The most salient point, at this juncture being all cash payments, aka royalties or whatever (no need to split hairs on this matter) are to be paid to the state's CONSOLIDATED FUND. Now, it is from this consolidated fund, state governments table a bill to appropriate monies for running the state.
The PDA forbids any monies to be paid into other agencies other than the state's consolidated fund. Hence if the money is from oil revenue and therefore is covered by the provisions in the PDA, assigning the monies other than to the consolidated fund is unconstitutional.

"UMNO isn't improving things either by rolling out the red carpet for PKR degenerates."
I like this sentence. Why should the backbone party in the Government embrace scums, loan defaulters, corrupted politicians, and political discards into their fold.
Now that is telling.

"Parpukari" is a tamil word meaning
Dhall gravy and the writer, if i am not wrong is refering to TDM.
The term parpukari is commonly used among penang island malays.

Dear Dato Sak

You are a true-blue Malaysian like TRH! I originally wanted to say true-blue UMNO member. But your opinions expressed here tantamount to a "clash of civilizations" with the UMNO "leadership". Does this mean you are also going to be hounded like TRH? Your reasoning is sensible and the payments are due under the PDA, no matter what the UMNO leadership may assert.

Perhaps the real question to be posed is, what does the great Tun Mahathir think? After all he did try to treat Petronas oil revenues as part of his "private" funding to resuscitate his cronies and family members!! He has been unusually silent on this matter.

I salute your brave words.

If UMNO lost but Malays win...Nah UMNO will never allow this to happen, even at the expense of the Malays.

Ir. Hanafi Ali 4 March 2010 at 17:59

I just had an epiphany.

When UMNO took some powers from the British in 1955 and all powers in 1957, UMNO took the power and kept the power to itself and continue to keep the power.

The power belongs to the people, and WE the RAKYAT decide who shall we entrust the power to.

UMNO is behaving more and more like the Malay sultans of the past.

lets imagine it this way. say the main party ruling the country is a non malay party...say a chinese party. and say there is a state exactly like kelantan with oil exactly like kelantan but instead of 99% malays the state is 99% chinese. what do you think this this chinese ruling party would do? don't give the measly 5% royalty to this state? you gotta be kidding. chinese are not retarded like the fucking UMNO leaders...they would try to give 10% instead of 5%.

god...i hate fucking umno leaders...

Greetings again Dato
You seem to play your cards well.Gud for u.Ur article implies that the guy u called nuts and the other one who missed the cue are in a state of denial. You are one brave soul.
If a layman had said such things he would have been behind bars.I wonder why?

Richard Cranium 4 March 2010 at 23:15

If the method of paying is unconstitutional, then it behooves the government to correct it immediately, no? Otherwise, Malaysia as a nation has no legal standing to exist, isn't it?

Anonymous,  5 March 2010 at 01:27

the entire episode is just a simple case of Umno refusing money to oppositions and nothing else.

It is their money, so they thought.

That is the way backward people think and act .. and they do thing they are democratic. LOL

Anonymous,  5 March 2010 at 03:00

Apa susah... Repeal the agreement lah. After all, its between consenting parties back then.

U mean to tell me Petronas and Govt can't change the PDA agreement?

Discuss this is roundtable discussion la.

And change the bloody royalty agreement.

Those who said the agreement is binding to eternity are idiots.

What was done when razaleigh was chairman of Petronas, can be undone by the current chairman.

Otak letak kat lutut semua.

Kelantan wants 5 percent? Ingat Kedah pun tak nak ka?

Negeri Sembilan pun mau juga.

Pak Zawi 5 March 2010 at 08:46

Dato',
The Kelantanese reasoning is simple. If Sabah and Sarawak can, why Kelantan cannot? Why Trengganu under BN can and later under PAS cannot? How to rebutt that?

Anonymous,  5 March 2010 at 09:46

people miss out on one obvious point.

oil royalty was asked by ku li because Kelantan is poor due to the lack of oil royalty.

thats all.

but in the first place, why is kelantan so poor?

you mean this state becomes poor just because it did not receive any oil royalty?

then how about other states who had not received any oil royalty every year?

Melaka, Pulau Pinang, Perak, Negeri Sembilan for instance.

Are these states poor although they did not receive any royalties?

No.. and these states are not poor at all.

Bear in mind, ALL STATES RECEIVE FEDERAL FUNDING...

including Kelantan.... that pitiful state of Nik Aziz receive billions every year from federal allocation.

Yet, they remain poor.. I do not hear other states who did not receive funding whining about their condition... they strive to improve their state.. brought in investments etc.. finding ways to attract people to come to their state.

Kelantan? Setakat doa pada Tuhan aje ke?

If you have a good leader, even without a single sen, you will know what to do in order to improve the state.

But Kelantanese was cursed with Nik Aziz's leadership who had blinded you all while nincompooping all of you thnking that it is God's will that the state is poor.

Ku Li come along and said.. wait a minute.. the state is poor because we did not receive oil royalty!!!

what a stupid logic.

State is poor because of the poor leadership for the past 20 years.

Royalti dipersetujui tahun 1978. Nik Aziz jadi MB tahun 1990.

Anonymous,  5 March 2010 at 18:32

JOE BLACK,

Are you saying in the history of the world, no contracts and agreements had ever been repealed?

people could use you in a talk show. you'll make people laugh.

Anonymous,  5 March 2010 at 18:43

hhhmmm....

Anon above is correct.

Any agreement can be amended if there are two consenting parties.

But in another news in Penang, it's one step further.

LGE can cancel any contract midway through a project without the consent of the other party and without any reasons!

Wakakakakaka!

Back to the issue at hand, clearly, the PDA is lopsided because other states do not receive any royalty. The oil is obtained not from Kelantan waters anyway.

Is this fair?

How to help the Malays, if they think like this? How to survive? I also malu, when I read this.

Tapi bila orang bukan Islam berjaya, kita puji.

— Berita Harian

Whoever said that the claims made is not from Kelantan Waters do not understand the PDA and Geographic location of oilfields offshore Kelantan.....The government has used the so called "Offshore Limits" of State Claims to justify depriving Kelantan of its rights. The same arguement is not used for other states with oilfields "offshore". There is no mention of offshore limits in the PDA. The Oil were discovered "Offshore" Kelantan.

In any case the Arguement is over DISCRIMINATION and not over "offshore limits".

"LGE can cancel any contract midway through a project without the consent of the other party and without any reasons!" Anon 18.43.

This is what happens when the MSM reports selectively and without investigating properly and many start frothing at the mouth without getting clarification. Here's what it all means as per MI 6/3/10 at http://www.themalaysianinsider.com/index.php/malaysia/55268-guan-eng-says-pdc-termination-clause-meant-to-protect-state:

"....LGE hit out at the prime minister for misunderstanding what he said was an administrative procedure that would not lead to any abuse of power.

The prime minister has been misled as this is purely an admini matter. He should have been better briefed by his officers, Lim told The Malaysian Insider.

Yesterday, Datuk Seri Najib Razak said Lim’s power as the PDC chairman to terminate contracts without giving any reason could lead to an abuse of power.

Lim clarified that an award can only be terminated before the signing of a contract, which usually takes place between three and six months after a contract is awarded. He said that termination could only happen if the PDC discovers any element of corruption or manipulation.

“It is only for the interim period. Once a contract is signed this clause lapses,” said Lim."

What's dictatorial about that? That's prudence you can't fault!!

All oil obtained more than 3 nautical miles from the shore of any state belongs to Federal Govt.

This include Sabah, Sarawak and Terengganu. Same apply to Kelantan.

Anon 22:39

According to Petronas report, Petronas has paid Trengganu RM 3 Bil, Sarawak RM 2.8 Bil and sabah RM 0.98 Bil of oil royalty.

Why Terengganu, sarawak, sabah get the 5% royalty payments for oils found beyond 3 nautical miles from shore while kelantan only gets wang ehsan?

hang faham ke tak arguement ni? jawab jangan tak jawab!
