The Perak Putsch

The Honourable Speaker!


This is my personal opinion only.

It's May Day for Justice. I am not referring to the book written by Tun Salleh Abas. I am referring to the May 7 Putsch in Perak and the despicable behaviour of lawmakers. It was actually a Coup d'état that will surely guarantee the plotters and perpetrators an ignominious place in history.

All the PR had to do was to give enough rope for the BN people to hang themselves. If it was a putsch, then like such similar events in history, the Munich Beer Hall Putsch and the Algiers Putsch, they will fail. This one in Perak will fail to endear UMNO and BN with the people.

I have been asked about the Perak DUN Perak episode this morning. My opinions are as relevant as the next fellow's. That means, we can't avoid being judgemental. Either we accept or we don't accept what has happened. The following is my personal opinion not necessarily reflecting that of the majority in UMNO.

If we are for it, we can find 1001 excuses to support it. If we are against it, we shall find a similar number of rebuttals. As for me, I will echo what a senior UMNO leader ( who is presently in the government) said in another situation. It has come to a stage where even we (ministers) feel ashamed to ask people to vote for us. This latest Perak Putsch just builds up the resentment of the people.

The general opinion from people on the street? It is not acceptable and further injures UMNO being the backbone of the BN government.

What happened in Perak is no longer amenable to legal niceties. The top legal eagles will have their day in court and if the judiciary is full of correct-correct-correct judges, the decision of the court of law will no longer be relevant. The court of public opinion and the sentence that will follow suit overwhelms everything- you and I, the lawyers and constitutional experts.

Perak will become the political quicksand that will drag Dato Najib in. Unless he gets out from the quicksand either by being pulled out or grabbing a pole as we see in the movies, Perak will prove to be his political waterloo. That will mean, the victory he secured over Anwar Ibrahim in persuading the 3 guys to quit PR, is a pyrrhic victory.

The only honourable thing to do is to remit the whole thing to the rakyat and that means calling for a fresh elections. It's better for UMNO to lose honourably than to win detestably. Unless of course we are deaf to the resentment building up among the rakyat, we will insist on staying. That resentment has reached a stage where what UMNO says is no longer believable and where lies dished out Pakatan and its high priest Anwar are believable. We lose more by our obstinacy.

The thing that people remember was the speaker being forcibly carried out. The photo showing the poor speaker being dragged out will be forever etched in the mind of millions. It was high-handedness at its most foulest.

Let's discuss this a bit.

The House enjoys a stature of sanctity. It cannot be violated. Its proceedings and deliberations therein are unimpeachable. The lawmakers performing their duties in session enjoy immunity. The master of the House is the speaker. His person cannot be violated. Only he rules supreme. Not the clerk on duty. Not the secretary of the dewan. Not the sergeant-at-arms. These are servant status obliging what the Master instructs.

If it's accepted that what is said in the Dewan enjoys immunity, there is a stronger reason to accept the principle that the authorised persons in the dewan is inviolable.

Who were the people violating the speaker? Can they be in the dewan in the first place? Who ordered the physical ejection? Was it the deputy speaker? On what standing? The speaker cannot be deemed to be absent from proceedings. He has not been removed. In order to have him removed, there must be a motion and if the motion is allowed by the speaker, it is deliberated and finally a vote taken. Was there a motion and was it debated?

The prerogative of accepting or rejecting any motion lies with the speaker. If he disallows a particular motion, there is nothing anyone can do about it. Even written questions need to be submitted to the speaker- he sifts through those question and allows those he judges to be allowable.

Anwar Ibrahim and the PR parliamentarians have moved to table several motions but in the end, the speaker decides whether to allow them, to be heard. It is not the case of whether can allow or refuse to allow. Everything can be allowed provided the speaker allowed them. The speaker is the master of the house.

How do you remove a sitting speaker?

As a former ADUN, in my opinion, the speaker can be removed by presenting a question of privilege and declaring the office of speaker vacant. I think the removal of a sitting speaker cannot be done through the courts.

The next question we ask, what is a Question of Privilege? If what is practiced here is the same as those practised elsewhere in countries that follow the Westminster style of Democracy, then Questions of privilege shall be, first, those affecting the rights of the House collectively, its safety, dignity, and the integrity of its proceedings; and second, those affecting the rights, reputation, and conduct of Members, individually, in their representative capacity only.

A Question of Privilege also includes Questions relating to organization. Privileges of the House include questions relating to its organization and the title of its Members to their seats. Questions regarding these may be raised as questions of the privileges of the House even though the subject has been previously referred to committee Such resolutions would include those to declare prima facie right to a seat, or to declare a vacancy.

A resolution electing a House officer is presented as a question of the privileges of the House. To me, a resolution declaring vacant the Office of the Speaker is a matter of high constitutional privilege. Privileges of the House, as distinguished from that of the individual Member, include questions relating to its constitutional prerogatives. The constitutional prerogatives of the House also include its function with respect to: impeachment and matters incidental thereto

In short, the rules of the Dewan provides for the removal of a seated Speaker, during session, for the purposes of preserving the dignity, and the integrity of its proceedings under the constitutional prerogative of its function with respect to impeachment. This can be done and MUST be done to reclaim the integrity of the Dewan and to hold this government accountable to the rule of law!

It is never accomplished by ordering people to drag out the speaker. The person/persons ordering must be referred to the committee of privileges. The Dewan is not a Balairaya where JKKK meetings are held. Otherwise, the ADUNs and all members therein, are just spruced up JKKK members.

  2. I think it is even more despicable that all this was done by so called Muslims.

    Tun Dr. M, (whom I believe has done far more harm than good), said one thing which I still remember.... that more Muslims are killed by other Muslims than by one one else...

    Now can we ever wonder why the non Muslims look at us and spit. Even if the BN politicians have gone to the gutter level, where are the so called guardians of Islam, the MAIP, the Ulamas and the such who had so much to say about the conversion of a tiny child.

    I am ashamed to be called a Muslim amidst such ignorant and disgraceful people.

    I pray and I have exhorted my whole family and all over whom I have some influence to pray that this bunch of so called political leaders, and the other organs of Government will be punished in this world. And in front of all of us to see!

    And for the Head of Islam of the State of Perak, I just canot find the words to convey how I feel. Hope he knows that Hell is a fire whose fuel is men and stones!

  3. but what if the QUestion of Privilege is denied by the Speaker?

    if the motion filed by the MAJORITY of the adun in the house is denied by him, what can u then do?

    sometimes, the blame must be put to the aduns who do not know that they are in the minority....

    NST's Zubaidah wrote than Dr ( MALU BESAR) Zambry has got a so-called plan B, but as things went through yesterdya, it turns out that PLAN B is nothing more than calling in the tyrants in Barisan to the fore.

    Dr Zambry...nay, the BN state goverment in Perak has passed the point of no return with this latest transgression, and it looks as if the people's vote the last GE was indeed justified.

    I think they will have to "rub a whole lot of backs" in these three years or so if they want to avoid ultimate defeat the next GE.

    A defeat that would be sweet.

    Dr zambry should enjoy being the illegitimate MB while he can as it won't last.

    Thank you for being a level head amidst this whole fiasco.

    As a loyal anak Perak, it pains me to see my home state, its institutions and even its monarch dragged through the mud by unscrupulous politicians hell-bent on grabbing power at all costs.

    With the precedent set a such, we can only pray that this virus will not spread to other assemblies, where sham court decisions are made to justify assembly sittings enforced by gangsters.

  6. Disgusting! The assembly is one of the most "sacred" institution in a democratic state. It is where the laws governing the people are passed.

    Know we know why many Malaysians show little respect to the law. They park and throw rubbish anywhere they like. Ignore traffic lights. Dont file their taxes.

    Their leaders also show little respect. Bapa borek anak rintik.

  8. IMHO, the Sultan should dissolve the DUN asap and to declare that he would not want to see any of the existing ADUNs in the next seating.

    This would close a Blach Chapter in Perak history and hope the new ADUNs would be more sober to face the real challenges.

  9. Dato' I may be an ordinary voter and as a Malay that begin my life in a Kampong that is surrounded with UMNOism, my vote has never been betrayed.
    But yesterday dragging of the speaker is making many people so disappointed with the BN/UMNO. Many felt disgusted and true to your writing it is so despicable.
    Will PM Najib gives a pet on Zambrie or will he keeps playing safe as usual and UMNO will be destroyed sooner or later.
    Shameful, PM must act, it is now or never. It is unthinkable and just many people are saying that this has to happen during our time. Perkara ini di lakukan olih anak Melayu berugama Islam dan mempunyai pelajaran ke tahaf Phd.
    This is what was said by Speaker Siva during the scuffle "I am the legal speaker and why am I being treated this way", what is your feeling Dato'? What is your feeling Dato'?

    No doubt that majority rules. But ours is a constitutional democrary. Every procedures must be based on the constitution simply because the constitution is supreme. That is what differs a Legislative Chamber to a kindergarten playpen.

  14. Speechless...nothing that one can say .Even Simon Cowell will be lost for words.
    No standing ovation for anyone that was participating in the show in Perak yesterday.
    Its tragic,its a defining moment and its definitely 18SG material.
    The events was a big blow to one malaysia and the values of our PM >>>Culture of Excellence,Humility,Acceptance,Integrity,etc etc...and definitely Education.
    And everyone was a loser especially us .

    This whole episode started with the call by PR's defacto supremo for MP's to hop accross to the opposition.

    DSAI failed to convince the 30 MPs, instead BN managed to convince the 3 Perak ADUNs to become independant.The court has correctly decided that any presigned resignation was invalid thus effectively giving the majority to BN.

    Nizar, requested to dissolve the assembly but the Sultan declined (I believed this is a discretionary power by the Sultan as provided in the Perak State Constitution). The Sultan was convinced that BN controlled the majority in the State Legislature. Therefore by convention Nizar should have tendered his resignation such that to pave the way for the Sultan to appoint a new MB.

    Despite being held the resignation invalid, the PR speaker wrongfully suspended Zambry and the EXCO appointed by Zambry. Isn't there a separation of powers between the Executive and the Legislature? Shouldn't the speaker convened the State Legislature such that a vote of confidence or no confidence be taken to determine who has the support of the majority of the Legislature?

    There were many events that PR had failed to comply with conventions or the state constitution:

    1. Nizar resigning when Sultan refused to dissolve the assembly.
    2. The Speaker suspending the new MB and the members of EXCO.

    We all are too engrossed of the other matters but we have overlooked that PR too were not complying with the Perak constitution.

    Bravo! Well said. At least they can't charge you as guilty by association since you have put forth your personal opinion. The 6th PM's tenure may break the record as the shortest tenure of any PM's and with him BN/UMNO may go down the gutter as an irrelevant entity in the future history of the nation.

  17. I like your level-headedness and objective views. I totally agree with you.

    UMNO is on a suicide mission. I have often found UMNO's arrogance and rampant corrupt acts irritating. What happened yesterday was something else: it was evil. And I don't tolerate evil. I think a lot of people like me will support Pakatan at the next general election, as a way of punishing UMNO.

    I love this country too much to let this continue.

  19. The sanctity of the center of democracy i.e. the Dewan has been violated. It also means that Parliament is not what it had been. The precedent is being set.

    The message from yesterday is democracy is dead in Malaysia. So why bother with the state assemblies and parliament. These are now no more than charades.

    So why bother with the next election. Or is there going to be a next election.

    I know you would have dissolved the assembly if you were Najib but if you were Zambry, what would you have done in the same situation?

    I doubt that you would have sit there and tolerate SIVA's behavior until he poops up in his seat!

    Somebody had to roll up the sleeve, do the dirty jobs and take the garbage out. Kudos that they did.

    This is exactly what BN should have done in the first place, force the speaker to convene a special sitting to vote on this. The motion should have come from a BN ADUN. A government cannot be brought down outside the Legislative Chamber. Remember the Stephen Kalong Ningkan case? And what rights did DS najib have to seek an audience with the Sultan to present BN's case. For the sake of the sanctity and independence of the Perak Assembly, BN ADUN should have selected among themselves a candidate for MB and prior to presenting their case to the Sultan.

  22. When all is said and one, some things are now crystal clear.

    When UMNO/BN/Najib ran out of Constitutionla and Legal loopholes, they resorted to sheer thuggery, scurrilously and illegally aided and abetted by the Sergeat At Arms, Civil Servants and the Police.

    There is a scene in the movie 'Brazil' where diners at a restaurant carry on eating as though nothing had happened, while a terrorist bomb goes off outside spewing glass, debris, blood and gore everywhere.

    Raja Nazrin's reading of a bland speech meaninglesss while mayhem had just occured is reminiscent of that scene in the movie.

    How could a new Speaker be 'elected' when the State Assembly had not been officially declared opened (by the Sultan), the Constitutional Speaker had rejected various motions and the post of the Speaker was not vacant?

    Yes you are right Sakmongol AK47. Najib will have to call for fresh elections much against his wants or Ipoh and Perak will, figuratively, become UMNO/BN's Vietnam!!

    And yes, they have just about won the battle, but surely lost the WAR!

    There may be a bunch of tribal Umno elements who have no higher purpose in life and who can't recognize the magnitude of the hatred people have for Umno as a result of its own undoing, but that again isn't the problem. Feudalism is a Malay thing and you can accept, but Umno has no great leaders. It has only leaders. And a leader does what his supporters wants but a great leader does what his supporters don't want but aught to be. Umno needs a leader who will make it cross a new frontier. What has happened yesterday won't convince anyone that Umno has hopes. People have feelings, I asked my aunt, a 70 yr old grandmother whether should continue voting for Umno, this was her response: "I did it for decades, but I don't think I can again. Not that I have started to hate Umno, but I fear I may pertake their injustice and Islam forbids that."


    At that moment, I remembered the Quranic verse that reads:

    "And guard yourselves against a punishment which cannot fall exclusively on those of you who are wrong-doers, and know that Allah is severe in punishment." (Quran 8:25)

    Najib shouldn't try to satisfy the emotional wreacks in Umno, otherwise the hatred that will grow out of it will consume him and Umno. Mark my words. What happened yesterday was wrong by any measure. And no amount of si plistic arguments and boorish Pakatan did that or that would help.

  24. Spot on sir. Your assesment and views on yesterday's political tragedy in Perak speaks well of your objectivity despite being a former Umno assemblymen.

    Being a former journalist and having covered many political dramas in Msia,I have to admit yesterday's circus was the most embarassing and unthinkable act by Umno/ BN.

    Too many things to say here but bottom line is, Umno/BN has got it all wrong. In fact, it only cemented the rakyat's anguish and frustrations of how democracy is being managed/manipulated here.

    Look forward to the High Court's decision on Monday. Whatever the outcome is, Umno/BN has already lost the plot. In football, we call it game over due to wrong strategy and players. Like Benitez, Wenger and Hiddink quests to outshine Sir Alex Ferguson and end up being ashamed by the master and his RED DEVILS.

    The BN illegal state government of zambry and the goons have their hands tied.they WILL NOT ask for the disolution of the DUN. It is also impossible for the perak sultan to undo what he has done.

    as i can see it the whole thing can only be resolved by only two options:-

    1) THE COURT DO THE RIGHT THING.
    they have made questionable decisions before but it's not too late. for a start they can rule that Nizar is rightful MB of Perak....

    but i'm not hopeful. i've lost hope with the court when anything is related to politics.

    2) the act of god. force majeure. deus ex machina as in the literary device.

    to put it simply... say some of the BN ADUNs suddenly drop dead or some crazy people shove C4 up the 3 ex PKR vermins' bums and blow them up to high heaven.

    then we can happily have another series of by elections and sort things out.

    option one...remote possibility option two...hmmm...god works in mysterious ways they say... lets all kneel down and pray to all the various versions of ALLAH shall we?

    If UMNO/BN has to learn the hard way so be it lah.

    It can reach the very bottom of its shelf-life but it will certainly rise again, provided it treats its component parties equally.

    There should be no more Ketuanan Melayu or Pimpinan Orang Islam messaging.

    For the Perak episode, the number of non-Malays who were appealing to the royalty for fairplay - it shows that this group has accepted the fact that the royalties have a vital role to play in the country.

    When these people can speak BM fluently, understand the Constitution, show respect for the royalty and want to do things in a democratic manner - they are still viewed by some as 'Komunis, and Kelings'.

    Did they retaliate crudely?

    They chose to ignore as they know that these are distractions to the more important things that they are striving for.

    (Does not mean that the Pakatan folks are all angels anyway. They also have frogs and weak hearted ones who resign for flimsy reasons)

    But UMNO/BN alone cannot claim that it is the only alternative for the rakyat.

    Instead it should be more innovative to be the 'darling' of the rakyat.

    Look at the Speaker's position.
    Had BN won in Perak on 8 March 2008, would it have ever gone to the MIC? I doubt.

    But now, the BN emulates the Pakatan. IN BN takes back Selangor, the speaker will be likely from MCA or Gerakan?

    If only the BN had been fair in distribution of such responsibilities to its coalition partners, and ensured all 'lapisan' of the rakyat's needs were taken care without the tinge of 'supremacy this and supremacy that' there would not have been the Pakatan.

    Dr M wanted to codify laws, so that there will be no abiguity in the interpretation by the courts.

    I do not think he ever did it during his time. He left it out on purpose - to suit his needs then?

    Which is why the courts said recently that they can decide on decisions by Committees in the state assembly, and signed by a Speaker.

    Now that BN has set the ball rolling in the wrong direction, what is there to prevent the Pakatan from trying same 'stunts' in Parliament and in other state assemblies?

    What is good for the goose is also good for the gander?

    And on the other side, we have details of abuses of business dealings coming out slowly, implicating the national ruling party.

    The Port Klang Free Zone transaction traces the deals to personalities in UMNO.

    The new LCCT in Sepang is now estimated to cost mote that the new airport in Labu that was proposed by Tony Fernandez.

    So, where is the leakage and why is the rakyat's money going down the drain or into some evil pockets?

    With so much to address, will UMNO/BN regain its 'high command'?

    It is so sad, that it has to happen to an istitution that ruled the country for more than 50 years.

    But I believe, it is for the good.

    Look at India.

    The National Congress was solid all the way, but it was also defeated and since then politics in India has been refreshed.

    It is the same Congress that returned to power, after learning to understand its citizens needs better and now look at that country's development. This is despite opposition parties ruling in several states in that country till now.

    BN/UMNO can also do it.
    Even in defeat, it should just go back to the drawing board to strategise better - at regaining the people's confidence, not scheming to overthrow democratically elected governments by alternate political parties.

    The fun is not over yet.
    By Monday the courts will decide who is the MB. But it wont stop. The 'loser' will go to the Appeals Court and then to the Federal Court. All these take time.

    The rakyat of Perak will have to wait a little longer I suppose.

  27. This physical eviction by trespassers leaves the people with no other conclusion than one:

    that Umno's program of reforms excludes reforming itself to respect the will of the rakyat in general and, therefore, the motive behind those reforms is less for the rakyat and more to cosmetize Umno for the next general elections.

    If this be the case, how can Umno expect to do better in all states when it showed no inclusiveness in even one state?

    If something looks undecided, get it decided once and for all - fresh elections to settle the matter at the poll booth.

    Perhaps Umno already knows the outcome of doing that. It is precisely because it knows that therefore it must show it has the bravery to let the rakyat pass their sentence. That way, the motive of the reforms will get a chance to flower.

    Now, it looks wilting. Sigh.

    Sad day for democracy in Malaysia. The repercussions are wide ranging and the consequences are dire. The best solution is to dissolve the state assembly and seek a fresh mandate from the rakyat.

  30. I'm not a member of any political party. In fact, I'm sick of politics. I just want to see people respect the law.

    Aggrieved parties always have recourse to the law. That it will take time or cases will be heard by politically correct judges is another matter. If you can, you may try and change the Government, speed up judicial processes, put in non-politically correct judges, etc. It's easier said than done. Look at India and Pakistan. How speedy judicial processes and how correct the judges there are. Nearer home, look at the Philippines and Indonesia. Are they any better? Of course, cannot compare with UK or the city-state down below.

    Right or wrong, the Ruler has taken the stand that the Nizar Government has lost the confidence of the State Assembly. They should have resigned, did not, and was deemed to have done so. The almost half hourly news reports on the proceedings of the 7 May Assembly showed the endless attempts to get the Speaker give up his seat but he refused. The Police plain clothes "ushered" him out as he very clearly was blocking proceedings of the day. The Police is not to blame as they were doing their job. They would have done it even if it was a BN Speaker under the same circumstances.

    The case is before the Court. The authorities have already announced that a decision would be made on Monday. Isn't that a speedy enough judicial action? We should wait for that and bear with the legal provision for appeals and counter appeals. Even those wanting to change the Government have to wait for years. Even if they are in control now, they would not allow elections to be held unless they deem it to be in their favour.

    That's why I dislike politics but have long accepted the fact that I have to live with it. That's democracy. We are lucky that we don't have the frequent fist fights that occur in the law- making body of one Asian country.

    What a pleasant surprise. Your piece is truly a breath of fresh air. UMNO is stinking to high heaven and will stoop to the lowest levels to cling on to power.

    To understand the separation of powers and to articulate it as well, I salute you. You are a man indeed and did the right thing. BN doesn't not have many anak jantan left.

    The 'win" in Perak is now a heavy liability for BN in the next GE. Hence, Najib's reign as PM could be a very short one.

    For UMNO to redeem some respect, with the "false" speaker and MBs in place plus their small majority, BUBAR DUN and go for by-elections.

    Kalah pun tak mengapa. It will regain a lot of political mileage for BN.

  32. I was waiting all day if there would be one human being from BN with a conscience and principles to stand up and say that a grave wrong has been committed in Perak.
    It takes great courage to stand by principle in a lawless surrounding as we see today. But you did man!

    Dear Dato, I never had any respect for BN leaders but I salute you. You must be a man of God, a respecter of truth.

    At least we have one decent guy from UMNO who dare call a spade a spade when some of its leaders continue to defend the undefendable.

    how could it be democratic if someone who dont get the most vote become the PM? how could it be democratic if someone who dont the most support of adun support become MB? how could it be democratic if speaker with no majority support still hold on to the seat? come on .. its clear on who is supposed to be mb and speaker... but still umno/bn will be blamed becos their spin doctors are not as good as pr's.. eg dato sak himself... to me its very clear, the person who get's the most support become the mb and the most adun support will also become the speaker...

    You don't seem to get it. When the sultan refused to dissolve the assembly (when by right he should) he SHOULD have asked the assembly to be convened and a vote of confidence taken to remove Nizar.
    He has no right to sack Nizar, Got it.
    Going by your reasoning Karpal, Gobind and all DAP MPs who are consistently been asked to leave the dewan may well refuse to do so in future. Can UMNO blame them?
    Can PK MPs walk up to the Speaker and give him a knock on the head for refusing to allow a motion. Why not? If UMNO can carry off the Perak Speaker what's wrong in giving a knock on the Dewan Rakyat Speaker's neck.

    Budak muda yang beriman itu ada peluang untuk melarikan diri. Dia sendirian di puncak gunung, menyaksikan kejadian yang dahsyat itu. Tetapi perjuangannya belum selesai. Dia pulang ke istana, mencabar raja yang zalim itu. Ada seribu satu hikmah daripada pilihan budak muda itu.

    Setibanya dia di istana, raja amat terkejut.

    “Apa yang orang-orang kamu sudah buat!” herdik raja kepada budak itu.

    PENGAJARAN

    Cerita di atas adalah petikan daripada kisah anak muda dan Ashab al-Ukhdud di kota Najran. Ia dikisahkan oleh Allah Subhanahu wa Ta’aala di dalam Surah al-Buruj, dan diperincikan oleh Baginda sallallaahu ‘alayhi wa sallam di dalam sepotong hadith yang panjang di dalam Sahih Muslim.

    Kisah itu penuh iktibar.

    Tetapi salah satu kejutan besarnya ialah, tindak tanduk raja pemerintah yang zalim itu. Pelbagai pendedahan dilakukan oleh Rasulullah sallallaahu ‘alayhi wa sallam tentang isi perut dan benak hati raja yang zalim itu, agar kita meneladaninya sebagai petunjuk sepanjang zaman.

    Lucu sekali, raja itu ramai orang suruhannya. Diarahkan mereka agar mengheret budak itu ke puncak gunung dan kemudiannya ke tengah lautan untuk menghapuskan kebenaran. Tetapi tatkala orang-orang suruhannya gagal melaksanakan misi itu, sikap raja terhadap orang-orangnya terus berubah.

    Kata raja itu (seperti yang disebut di dalam hadith):

    khianat

    “Apa yang orang-orang kamu telah buat?”

    Tidakkah ganjil, raja itu menisbahkan orang-orang suruhannya yang gagal itu kepada budak yang dimusuhinya?

    Demikianlah para Ulama’ menjelaskan, bahawa itu adalah sikap pemerintah yang zalim. Ketika dia mahu menggunakan orang-orangnya, pelbagai perkara dibuat untuk membina kesetiaan. Tetapi orang suruhan yang setia itu, tatkala khidmatnya sudah tidak diperlukan lagi, dibuang begitu sahaja tanpa sebarang erti.

    Inilah pesanan Allah dan Rasul buat sekalian pencacai yang memperhambakan diri kepada manusia zalim dan kezalimannya, yang sanggup bermati-matian melaksanakan kerja-kerja kotor majikan yang menggajikannya dengan sekelumit habuan dunia, kalian hanyalah tebu-tebu yang habis madu sepah dibuang.

    Andai masih ada ruang dirimu diselamatkan…

  37. This will be one of the saddest moments in Malaysia's political and constitutional history. It just doesn't seem to get better - the 2 Constitutional Crises; the farcical Anwar sodomy charge; and now this.

    It may sound idealist, and somewhat preachy; but Malaysians all of ethnicities must make a stand - our politicians are no longer a credible represenation of our electorate (albeit a gerrymandered one).

    If Malaysia is truly a democracy - then the people determine the destiny of this country. That is the ideal of a representative government.

    The desire to perpetuate their political power far beyond their use by dates leaves me wondering whose interests these politicians are representing; save going into another heated debate about the NEP (or more correctly UMNO's economic policy; as I have yet to see the Malays of the kampungs receive any major funding!)

    Malaysia is a lucky country - blessed with resources, access to a major international shipping lane, and incredibly resourceful people. Please don't let a bunch of douchebags ruin it for you by making it a lucky country for themselves!

    One person can only do so much; but the power of an idea is that it cannot be defeated - tell your children, tell your friends, tell your family, tell someone from another 'bangsa' - that you and I are MALAYSIANS (not Malay, not Chinese, not Indian, not Orang Asli) and I'm not going to take this shit anymore.

    the cops in this instance have breached all parliamentary protocols.

    in any event, who has the majority is disputed. the speaker has every right not to accept any motions;just witness the performance of the parliamentary speaker.

    at the end of the day, we can argue till the cows come home. there's no solution except to go back to the people for a mandate. and also, to relearn to respect the constitution like before mahatir's time. everything flows from and thru the constituion and if all instittuions respect that, this country will be mightily blessed.

    its nice to read your long writings but most of it are inconsequential details. if we just cut to the chase the way i see it the facts are as follow:

    1. bn + 3 independents have the majority

    2. pr ask the sultan to dissolve the parliament

    3. the sultan says no

    4. given point 3 according to the constitution the mb shall read wajib resign.

    5. end of story but no..

    6. the may 7 putsch as you put it is due to the pr trying to hang on to power that they lost by frustating the system in every conceivable way they can think off legally or otherwise, trying to create a situation of anarchy. the pr got nothing to lose, why make it better for the bn and as a consequence the rakyat, seems to be the thinking.

    7. legally its going to end with the court decision monday basically on point no 4 which is the point of contention. you already see it fit to pre-empt any court decision against pr by insinuating that the court is not fair, what else is new? otherwise though, we'll continue to see a lot of the anarchistic behaviour - which is the forte of Anwar, from the pr until the 13th GE.

    I disagree with your view. Bowing to the demands of PR makes no good to BN. PR has no interest to see justice, democracy, transparency, accountability, credibility, abolishment of ISA or whatever you can name. Their sole interest is to bring down BN at any cost.

    When BN bow to their demands, they will find another excuse to make BN looks bad and desperate. Look and the recent release of ISA detainees when Najib becomes PM. After it was announced, PR will make another story to undermine his effort.

    From the leadership stand point, you must not bow to the demands of your enemy when you have no reason to bow to them. What more if you were to dissolve the duns. That would make you look stupid, weak and erred. Certainly not.

    I personally do not want to see another by election for the entire state of Perak. Enough of our time, money, energy and resources being dumped into these unproductive by elections. Enough of the dramas. Let the 7 May drama be the seal of the dramas. It is embarrassing, but I believe both parties have equal share of blame. So be it and let it be.

    For the record, I must point out that the Sergeant-At-Arms, the civilian employee designated to assist in the maintenance of order inside the Assembly, was called upon to act, but he didn't or couldn't. What could he do, being a civilian and presumably with only a handful of assistants, under a situation where one group was not respecting the other, periodically shouting to each other?

    I don't know the House Rules but perhaps this is an area where Assemblymen should next look at in terms of violability of the Assembly - clear guidelines as to what the Sergeant-At-Arms is to do under that situation. The logical thought is for him to call the police. Do we know if it was him who called the Police in the recent incidence? If he did, don't blame him: he was just doing his job.

    How I wish politics in this country are conducted minus the lompat melompat and the excessive pandering to racial sentiments.

  43. The issue as to whether Zambri's appointment is valid is essentially Nizar's position as the MB.

    The contention is that Nizar can only be dismissed by a no confidence vote in the Dewan.

    Events of 7/5/09 very2 clearly show what would have transpired if the Dewan was to sit prior to Zambri's appointment/Nizars removal.

    The Speaker would have barred the 3 "independents"...and there would be chaos...and a stalemate.

    Where would all this lead us to?

    The various issues will be played out in court for years and years.Whoever is the prevailing government will not be able to function effectively.The rakyat suffers..and loses confidence in the democratic and legal processes.

    The only viable solution is to go back to the people for a mandate.Even football allows for replays?Whats 3 weeks of heat and millions of dollars for the elections compared to a prolonged crisis?

  46. A fresh election in Perak is inevitable. It has been the case ever since voters in Perak produced a rojak Assembly, at the March 2008 elections. The Ruler presented both sides an opportunity to form the Government; The Ruler settled on Nizar because he seemed most able from the interviews. The Ruler must have subsequently in his weekly encounters with MB Nizar screened his Mantri; probed into the power structure that propped up a Mantri with so few Assemblymen from his own ranks.

    The Ruler could have sensed that the precarious Government he put in place, was wobbling. What would the solution? Then came the Bota episode and subsequent "lompat". It was not the most ethical solution because Anwar should have been allowed to wallow in the bad choices he presented as election candidates. It would have been another evidence that PKR is a bad replica of Umno (plus non-Malay politicians of the Tian Chua mould).

    Instead Anwar was able to "transfer" the two liabilities to Umno. Naturally the conduct of the Pakatan activists mirrored that of their brethrens in Thailand. That was not honourable. Tian Chua and his comrades have foisted on the nation a brawling-type of politics; but they were able to do so and not be lynched due to BN's own political blunders.

    Pakatan and BN have damaged themselves equally since the Perak episode popped up. I have a feeling the youngish, thoughtful Menteri Besar of Perak from Pangkor, will emerge as one of the our outstanding politicians. But he must first win the election.

    The Assembly should be dissolved before the end of the year. Let things calm down a little. The partisans like fathersez must not aggravate things; no we dont need a finger pointing frenzy.

    I feel very sorry for you and honourable like Tenkgu Razaleigh. The present AMENO that cunningly took the place of the old UMNO is not a truly democractic instution. The glory days of the true UMNO died when Che Det raped and sodomised our constituion and all instutuions that are were supposed to safeguard it. All these fiasco in Perak smells the dirty work of Che Det behind the scene. The same scoundrels involved in judgefixing and jugdement fixing scandal under Che Det are also involved in this sinister plot. I can only pray to Allah Almighty that true and honourable pious and God fearing Malays like you and many others in PAS would rise above and start publicly critizing this flagrant abuse. Even our beloved Tunku is restless in his grave. May Allah guide us in these difficult times where we are witnessing the end of the transition of the Dark Age and the begining of the Golden Age that Allah promised us.

    What you said looks to be correct on the surface but if we go deeper into it, we should realize that there are house rules to follow to overcome such a situation.

    If Nizar is wrong in refusing to resign, then it is even more wrong to adopt the bullying tactics that BN had used. Even TDM recognized that.

    BN Perak has opened a pandora box and now decisions in the legislature can be challenged by the judiciary if Perak power grab is used as a guideline?

    Two wrongs do not make a right. Shame shame!

    I would say fire the sergeant-at-arms. No excuse should be accepted. He cannot point the finger at anyone. Just fire him with dishonourable discharge. i.e. no pension. This should prevent any civil servant who think he or she is smart.

    Next, fire the State Secretary. Ditto above.

    Tak guna untuk bercakap soal peraturan dan undang-undang di sini kerana jelas pihak Pakatan Rakyat pun tidak menghormatinya.

    Speaker Sivakumar bukan seorang Speaker yg adil dan saksama dalam menjalankan tugas. Mengapa dia boleh membiarkan sahaja ADUN2 DAP menyerang ADUN2 BN? Mengapa dia enggan mendengar sebarang penjelasan dari ADUN2 BN dan berkata 'saya tak mahu dengar'? berulang kali?

    Pembangkang dakwa majoriti rakyat Perak mahu DUN dibubarkan. Mereka dakwa mereka mendapat sokongan majoriti rakyat. Tapi mereka lupa bahawa dalam PRU yg lepas BN menang 28 kerusi dalam DUN Perak. Masa itu entiti politik yg kita sekarang kenal sebagai 'Pakatan Rakyat' belum wujud lagi. Ia hanya wujud setelah BN gagal dapat majoriti mudah untuk tubuh kerajaan. Pakatan cuba menjadikan protes-protes jalanan sebagai bukti bahawa rakyat Perak sokong mereka. Tapi bagaimana pula kalau penyokong2 UMNO/BN juga pergi merusuh di jalan raya? Mahukah kita situasi di Perak jadi seperti di Thailand? (Mungkin itu apa yg PAS mahu, seperti kata Kamarudin Jaafar).

    Mengapa isu integriti, maruah dan hormat kepada mandat rakyat tak ditimbulkan Anwar, Nizar dan Lim Kit Siang bila ADUN Bota, Nasarudin Hashim masuk PKR dulu? Kenapa Anwar dan Nizar tak minta Nasarudin letak jawatan dan adakan pilihanraya kecil di DUN Bota? Rakyat di Bota pilih calon UMNO/BN, bukannya calon PKR dlm PRU yg lepas. Mungkin kerana UMNO/BN sudah jadi pembangkang, maka tak kisahlah kalau kerusi mereka berkurang sekalipun. Tapi bila 3 ADUN pakatan keluar parti dan sebabkan kejatuhan kerajaan mereka, maka ini jadi satu dosa maha besar bagi pakatan. Bukankah Anwar yg begitu kuat mencanang cerita di sana sini bahawa dia akan tumbangkan kerajaan BN dengan menarik 30 ke 50 MP BN masuk pakatan? Ada integriti dan perasaan hormat pada undang-undangkah orang ini?

    Pada pandangan saya pilihan terbaik bukan bubar DUN sekarang, tetapi biarkan saja BN terus tadbir Perak sampai tamat penggal nanti. Sampai masanya, DUN pasti akan bubar juga. Dalam tempoh itu, Pakatan Rakyat buatlah kerja sebagai pembangkang dan buat dengan sebaik-baiknya. Carilah semua salah dan silap BN dan dedahkanlah kepada rakyat. Saya fikir ini kerja mudah saja pada mereka kerana bukankah semua rakyat Malaysia khususnya rakyat Perak sudah benci dan meluat pada UMNO/BN? Saya yakin dan pasti pada PRU akan datang, Pakatan akan menang 100% di DUN Perak.

    Kepada Dato', nasihat saya ialah janganlah sebab marahkan nyamuk kelambu dibakar. Saya tahu Dato' cukup benci pada Najib dan akan cari apa saja salah dan silap beliau. Dato' akan mempergunakan ketinggian dan ketajaman minda dan intelektual Dato' dalam berhujah untuk menyokong kritikan2 Dato' terhadap Najib itu. Saya tahu Dato' telah berjaya membina kredibiliti sebagai seorang blogger yg tinggi daya intelektualnya. Tapi saya minta Dato' janganlah jadi macam Sukarno atau Anwar yg salahgunakan kelebihan diri mereka itu.     I think now is the time for you and others like you to support and vote BN. At PRU 12, yes, you could have shown a protest like many others, including me, did then. I think UMNO got the message, only it has gone into a quagmire, very difficult to extricate itself from. Pak Lah did a lot of harm but DS Najib appears to be trying, though in ways we sometimes wonder about. Let him try.

    It's the Anwar fellow. Isn't he the biggest culprit in weakening the Malays? I think the man has no principles. He'll go for anything that he thinks will bring him power. He was an ABIM student leader. Quoted the Qur'an left, right and centre. Then he got sodomy charges - whatever the motive for bringing those charges. Sodomy occurred at MCKK during my time, I'm quite sure also during his time. Those charges were preferred as a result of investigations by the police led by a very respectable IGP, Tun Hanif Omar. No one should ever imagine the Police report was cooked up.

    The man was picked out and nurtured into leadership by Tun Dr Mahathir. Still young, he should have waited for his turn, instead of trying to guling TDM thru Pemuda's charges of corruption and cronyism. When he was a part of that system himself. Books written about the anomalies of the period also mention his own abuses as a Finance Minister.

    Then he started the katak lompat thing. He didn't have the numbers but threatened a no-confidence motion in Parliament, the hu-hah wanting to see Pak Lah, when he didn't have to if he really had the numbers, when in fact, he was still drumming support for his idea from the non-staunch BN supporting MPs. They called his bluff, he failed miserably.

    Then, exasperated others wanted to give him a dose of his own medicine. They got three fellows to lompat in Perak. He became damn frustrated. Even the old lion does not recognise his leadership; he said he never did from the very beginning. Of course, the opposition parties generally exploited the man's ex-TPM credentials - whatever they were, for, after all, the opposition always finds faults with the government in power. They even won handsomely in PRU 12. UMNO and the Malays went in disarray.

    You see, if you don't support and vote BN the next time, the fellow who would benefit is that same fellow you said you hate, and the chauvinists. I would urge you to think again. Remember, quite a few in the UMNO leadership now has got the message sent by voters of PRU 12. DS Najib has spoken about changes to control money politics. He has got rid of many deadwoods and questionable fellows from the past cabinet. He can't change everything overnight. Rome was not built in a day, they say. Even a JKKK needs sufficient time to rein in wayward fellows.

    What you are advocating is going towards the days when Malays rule supreme and laments the loss of that.

    UMNO has for 50 years been dominating the entire country and just look at what the country has become. One of the biggest reason has been the desire to lord over others and get absolute power which the compliant MCA and MIC did con their own people. The country is going down south and still is.

    If without the support of the non Malays all these years through the bluffs of MCA and MIC do you really thing UMNO can really rule ? NO.

    Now do you know that in ANY COUNTRY the country can ONLY progress and prosper through peaceful co-existence? Only through the Maximum output of the entire population can a country every dream to compete with others?

    For the first time , through Anwar, we see the impossible happening. Indians/Chinese carrying PAS flags and PAS guys carrying DAP flags! Dont you think this is a miracle we should never destroy for this is the first step to national unity?

    If there is a nation whereby irrespective of race, everyone helps everyone to overcome the challenges of the nation and ensure the poor gets a better deal , wouldnt that make the country a far better place than one race wanting to lord over another?

    In a modern society where it is borderless, racism does not go far. Yes, you may have the majority and the power to lord over another, the aggrieved parties respond to it in many ways ... one of which is to help another country enjoy their fruits of their expertise.

    Who in the end losses?

    Wealth must come from somewhere created by all races Malays, Chinese, Indians etc and the desire to get wealth without working for it is just non sustainable.

  57. When the legal Speaker, Sivakumar, asked the banned MP's to leave the Assembly, the Sergeant at Arms did absolutely nothing to evict them.

    When they evicted Sivakumar, the Seargeant at Arms was seen assisting the plainclothes police (or was it Army)?

    Clearly there was a BN conpiracy to defy Sivakumar at ant cost, and the Seargeant at Arms, State Sec, other Civil Servants and the Police illegally aided and abetted them.

    The MSM has also maintained a complete blanket on who these plainclothes men wearing Official
    tags were. We must know the answer. Were any of them from the Sultan's guard detail?

    How is it pssible that Ganesan and these plainclothes police were allowed into the Assembly, but not Lim Kit Siang and teh MP for Ipoh Utara Kulasingam who had official invitations?

    There have been worse disorders in Taiwan and Japan Parliaments, but nowhere has the Police so blatantly and illegally defied the rule of law and State Assembly procedures as in Perak. Only a month ago, the IGP said the police could not eneter Parliament premises to protect Karpal Singh from UMNO goons.

    And lastly, how could any resolution passed by BN be valid when the SA had not been officially declred open by th eSultan or his speech debated?

    Kalau dah tak ade majoriti tu letak la jawatan.melalak merata tempat nak tunjuk teror n lagak.dia kata dia mempunyai sokongan rakyat konon.berapa kerusi pas menang.berapa kerusi umno/bn menang.

    PR memang nak pilihanraya.sebab yb dia tak ade kerja nak buat.bn sibuk.memang meluat la tenguk kesombongan nizar,ngeh,nga,siva tu.siva belumpun jadi menteri besar atau raja.alahai dengan hidung kembang dia memberi titah perintah.gantung yb bawah pokokla.

    dia orang tu memang ingkar perintah sultan.dah tu bila nak bubar dewan la, nak minta tangguh persidangan kena mengadap sultan juga.Persoalannye sultan perkenan tak nak jumpa dan berkenan dengan permintaan mereka.tak ade malu sungguh.

    Please tell me which will you choose between these 2 options?

    1 - Having a rematch for Khairy now when you know he is not popular

    OR

    2 - Support Khairy and let him strategize so that he can turn the table around despite how unpopular he is?

    I bet you had chose option 2.

    I wonder how in this case, you want BN to rematch when you know they're not popular and at the same time suggested them to waive the bless of having option 2?

    It's not a principle Dato. It's a 180 degree different view.

    Why is UMNO afraid of going back to the people. Is UMNO afraid of loosing badly. The perception one gets from this Perak fiasco where Zambry and his goons took over by using the machination of the police and brute force is indeed very embarassing, nationally and internationally and that too before even the courts can decide. This definately makes the rakyat feel that something fishy is amiss. If UMNO is afraid of Perak State Elections, I am wondering how is it going to face the people in 2013. I feel sad for UMNO which was a beautiful party when it was first set up by our eminent founding father and now after it being deregistered and registered again has lost all its semblance of honour and intergrity. Perhaps the Mahsuri curse of our fouding father is inflicting UMNO.

    You have addressed your comment to me but, as I've said of your writing before, I do not wish to have any dealing with you.

    Your talk about "Malays ruling supreme (in the last 50 years) and (now) lamenting the loss of that", "the desire to get wealth without working for it" (without mentioning the corrupt, you are implying the race), comparing Malaysia with Zimbabwe etc are simply nonsensical and objectionable. I'm writing this only to point these out.

    You have in the past not been sensitive to the feelings of others. I don't wish to say anything more as I might become offensive as well, it might be wasting my time and I'm not sure whether even this comment will be published.

    You are lucky to have been published; I've nothing to say on that as it is the prerogative of the blog owner.

  62. 1. Apabila MB hilang majoriti maka MB pun mengadap Sultan untuk membubarkan DUN.

    2. Adalah salah tidak membubarkan DUN dan melantik MB yg baru kerana:-
    (i) Sultan dianggap campurtangan dan berat sebelah.
    (11) Kerajaan baru bukan pilihan rakyat tetapi disebabkan lompatan Adun.
    (iii) Kerajaan baru dianggap rasuah
    membeli katak2 yg tidak bermoral.
    (iv) Menjatuhkan air muka MB yg digugurkan kerana diketawakan oleh musuh2 politiknya.
    (v) Sekiranya berlaku lompatan berulang kali maka berulang kali Sultan akan melantik MB yg baru.

    Oleh itu bubarkan DUN untuk dihakimi rakyat..keputusan rakyat diterima oleh yg menang dan yg kalah. Sultan pun bersih, MB pun bersih, Adun pun bersih dn negeri pun bersih.

  63. Komen yg ada dalam blog ini tidak menunjukkan pendapat yg sama dari majority kami di luar.

    Kami dah semakin jelak dengan permainan PKR yg tidak punya asas, dengan Ngeh yg mengikut nizar ke sana ke mari, nizar hanyalah boneka.

    Kami tidak mahu negeri Perak kami tergadai. Mungkin kami dan saudara2yg lain telah menerima bahana akibat kemarahan kami kepada UMNO dulu.

    Mungkin juga ramai kalangan anak2 Perak tidak lagi tinggal di Perak. Tapi kami yg masih di Perak dan sebahagian besar lagi anak-anak Perak di luar sana tidak mahu negeri kami tergadai dengan percaturan Ngeh yg sedang cuba utk menakluk negeri.

    Sebab kalau dia berjaya, dengan anwar2 sekali disumbatnya dalam jail. Dan juga yg lain. Percayalah!

    I have been an avid reader of ur blog. Sad to say that i m deeply dissappointed with ur article this time. U are opening the floodgate for all the BN detractors to join the fray in bashing BN. No one group is devoid of weaknesses. I have no doubt that if the situation was reversed, PR would have done exactly the same thing to BN.

    To fathersez, pl dont bring in the Muslim issue in this. It has nothing to do with religion, its political!
